Confidentiality Policy
1. Purpose
This policy protects the confidentiality of all proprietary, customer, and business information belonging to EM Customs (“the Company”). It applies to employees, contractors, suppliers, and any third parties engaged with the Company.
2. Scope
This policy covers all confidential information including, but not limited to:
- Client names, orders, and specifications
- Design sketches, patterns, and production methods
- Pricing, supplier lists, and contract terms
- Any other information marked as confidential or reasonably understood to be confidential
3. Definition of Confidential Information
“Confidential Information” means any non-public information that relates to the Company’s business operations, clients, or intellectual property, whether disclosed orally, in writing, electronically, or visually.
4. Obligations
All persons subject to this policy must:
- Use Confidential Information only for the purposes of performing their duties for EM Customs.
- Not disclose or share Confidential Information with unauthorized parties without written consent from the Company.
- Take reasonable measures to protect Confidential Information, including secure storage and limiting access.
5. Exceptions
The obligations in this policy do not apply to information that:
- Is or becomes public knowledge without breach of this policy.
- Is obtained lawfully from a third party without restriction.
- Is required to be disclosed by law or legal process (with prompt notice to the Company if permitted).
6. Return or Destruction of Information
Upon termination of employment, contract, or engagement, all Confidential Information in any form must be returned or securely destroyed.
Once a client’s project has been completed or the contractual relationship terminated, EM Customs shall not be responsible or liable for any breach, loss, or unauthorized disclosure of information by the client or any third party after such termination, provided EM Customs has complied with its obligations under this policy up to that point.
7. Breach of Policy
Any unauthorized use or disclosure of Confidential Information will result in disciplinary action, which may include termination of employment or contract, legal action, and damages.
8. Acknowledgment
All employees, contractors, and partners must acknowledge to comply with this policy as a condition of employment, contract, or partnership.
